TERMS AND CONDITIONS

Welcome to Elaila by Pooja. These Terms and Conditions ("Terms") govern your use of the website www.elaila.in (the "Site") and the purchase of any products from Elaila by Pooja ("we", "us", or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

1. ELIGIBILITY

Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. By using this Site, you represent that you are at least 18 years of age. If you are a minor, you may use the Site only with the involvement of a parent or guardian.

2. REGISTRATION & ACCOUNT OBLIGATIONS

If you use the Site, you are responsible for maintaining the confidentiality of your account and password. You agree to provide accurate, current, and complete information during the registration process. We reserve the right to suspend or terminate accounts that provide false information.

3. PRODUCT INFORMATION & PRICING

Accuracy: We strive to be as accurate as possible in our product descriptions and images. However, as jewellery often involves handcrafted elements and natural gemstones, slight variations in colour, size, and appearance may occur.

Pricing: Prices for our products are subject to change without notice. While we strive to provide accurate pricing, errors may occur. If a product is listed at an incorrect price, Elaila by Pooja reserves the right to cancel any orders placed for that product.

Gold/Silver Rates: For products involving precious metals, prices may fluctuate based on current market rates. The price at the time of order confirmation will be the final price.

4. ORDERS & PAYMENTS

Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason, including stock unavailability or suspicion of fraudulent activity.

Payment Methods: We accept major credit cards, debit cards, UPI, and Net Banking through secured payment gateways.

Taxes: All prices are inclusive of GST as per Indian Government regulations, unless stated otherwise.

5. SHIPPING & DELIVERY

Timelines: Estimated delivery times are provided for convenience. While we aim to deliver within 7–10 business days, Elaila by Pooja is not liable for delays caused by third-party courier services or Force Majeure events (natural disasters, strikes, etc.).

Inspection: Customers are advised to inspect the package for any tampering before accepting delivery. If the package is damaged, please do not accept it and notify us immediately.

6. RETURNS, REPLACEMENTS & REFUNDS

Policy: Returns are accepted within 7–10 days of delivery only if the product is defective, damaged, or significantly different from the description.

Condition: Items must be returned in their original packaging, unused, and with all tags and certificates intact.

Custom Orders: Personalised or custom-made jewellery is not eligible for returns or exchanges unless there is a manufacturing defect.

Damaged Goods: If you receive a damaged or incorrect product, you must notify us at returns@elaila.in within 48 hours of delivery, along with unboxing videos or photographs.

Non-Returnable Items: For hygiene and security reasons, customised jewellery, engraved pieces, and items sold during a Sale are not eligible for return or exchange.

Refunds: Approved refunds will be processed to the original payment method within 7–10 business days after we receive and inspect the returned item.

7. SALES AND PROMOTIONS

• Duration: Sale events run until stock lasts. We reserve the right to extend, modify, or terminate any promotion at any point without prior notice.

• Inventory: We reserve the right to adjust products and pricing within a Sale category at our sole discretion.

• Coupon Codes: Specific coupons (e.g., WELCOME10) apply to full-priced items only and cannot be used on new launches or sale items.

• Coupons are valid on a minimum purchase of ₹1,000.

• Only one coupon code can be applied per order.

8. INTELLECTUAL PROPERTY

All content on this Site — including designs, logos, text, graphics, and images — is the property of Elaila by Pooja and is protected by Indian and international copyright and trademark laws. You may not reproduce, modify, or distribute any content without express written permission.

9. USER CONDUCT

You agree not to:

• Use the Site for any unlawful purpose.

• Interfere with the security-related features of the Site.

• Upload or transmit viruses or any other type of malicious code.

• Attempt to copy our unique jewellery designs for commercial use.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Elaila by Pooja shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or website. Our total liability shall not exceed the amount paid by you for the specific product in question.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Elaila by Pooja and its associates from any claims, damages, or expenses (including attorney fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.

12. MODIFICATIONS TO TERMS

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, India.
